Promotion ("Promo") is active on the following dates & hours only: 10/27/11, 11/3/11, 11/10/11, & 11/17/11, between 11:00:01AM Eastern Time ("ET") & 2:59:59PM ET, or while supplies last on each date (each, "Promo Date", & collectively, "Promo Period"). This Promo consists of (2) phases: Offer & Sweepstakes, each described below.
Eligibility: Promo open to MasterCard cardholders who are legal residents of 50 US or DC & who are in New York, NY at time of Promo & prize award/fulfillment. In addition, Sweepstakes only open to MasterCard cardholders who are not current members of the MasterCard Priceless New York program at mastercard.com/pricelessNY. Offer & Sweepstakes entrants must be 18 or older, except employees & their immediate families (spouses, parents, children, & siblings & their respective spouses) & those living in the same household of each of MasterCard International Incorporated ("Sponsor"), MasterCard customer financial institutions, credit unions, alliances, & processors, Red Rooster Harlem, participating professional football teams, participating food trucks, Project Support Team, Inc., & each of their respective parent companies, subsidiaries, affiliates, retailers, distributors, officers, directors, governors, related entities, partners, partnerships, principals, agents, licensees, sponsors, representatives, successors & assigns, & advertising/promotion agencies (collectively "Released Parties") which are ineligible to participate/win. This Promo is not sponsored, endorsed, or administered by Facebook, Inc. By participating, you release & hold harmless Facebook from any & all liability associated with this Promo. Promo is subject to all applicable federal, state, & local laws & regulations. Void where prohibited. Participating Food Trucks: There will be approximately (10) participating food trucks ("trucks") in New York, NY on each Promo Date, & participating trucks will vary per each Promo Date. Visit Facebook.com/MasterCard (the "Site") for the names/locations of trucks for each Promo Date.
Offer Participation: Internet access is required for Offer participation. To receive Lunch Voucher ("Voucher", as defined below), the following (3) Offer Participation steps must all be fully completed:
- Offer participants must perform one of the following (2) activities ("Activities") prior to arrival at a participating truck to qualify for Voucher: a) Fan MasterCard on Facebook at Facebook.com/MasterCard by subscribing to MasterCard updates & wall posts. If you do not have a Facebook account, sign-up for free by visiting Facebook.com & following the enrollment instructions; or b) Tweet to @MasterCard about Offer using hashtag #PricelessNY. In the Tweet, submission must use hashtag #PricelessNY, @MasterCard, & conform to Twitter's (140) character limitation. To follow @MasterCard, visit Twitter.com/MasterCard or, from your Twitter home page, click on "Find People" tab & search for "MasterCard", & click on the "Follow" button of the official @MasterCard channel. Subject to Twitter Terms of Service & except where otherwise prohibited, submissions become Sponsor's property & will not be returned. Twitter posts containing obscene, offensive, or any language with messages inconsistent with the positive images which Sponsor wishes to associate are void. All Twitter posts must comply with Twitter Terms of Service & Rules available at twitter.com;
- Upon arrival at a participating truck on a Promo Date during event hours, check in with designated MasterCard representative ("rep"). MasterCard rep will request proof of one of your Activities. You may provide proof by displaying your Facebook and/or Twitter participation on your mobile device, or bringing a printed copy of your Twitter post and/or Facebook "info" page which lists your MasterCard Facebook fan status. Acceptance of proof is at sole discretion of MasterCard reps; &
- After MasterCard rep has verified proof of Activity, receive (1) Voucher valid for lunch at designated truck on that Promo Date during event hours. Limit (1) Voucher per person for duration of Promo Period, regardless of number of Twitter or Facebook identities used.
Sweepstakes Participation: Receive (1) Sweepstakes entry during Promo Period when you: 1) Meet eligibility criteria noted above; 2) Visit a participating truck on a Promo Date during event hours; & 3) Fully complete/submit electronic Sweepstakes Registration Form provided by designated MasterCard rep per instructions provided. Limit (1) Sweepstakes entry per person, regardless of number of email addresses used, for duration of Promo Period. Additional entries from any person/email address are void.
Your submission of an Activity or Sweepstakes Registration Form constitutes consent to participate in this Promo & for Sponsor to obtain, use, & transfer your name, email, address & other details for Promo administration. Released Parties are not responsible for lost, incomplete, incorrect, delayed, garbled, undelivered, misdirected, late, inaccurate or undelivered Tweets, Twitter or Facebook follow requests, emails, or entries (collectively, "Promo Data"); defect/delay in transmission or communication; theft, destruction or unauthorized access to, or alteration of, Promo Data; or for telephonic, human or computer failures, problems or errors, interruptions in service, Twitter, Facebook or otherwise, due to system upgrades, repairs, modifications or other causes; failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), electronic equipment, computer hardware or software failures, phones, phone lines or phone systems, traffic congestion on internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Promo, including, without limitation, errors which may occur in connection with Promo administration, processing of Promo Data, verification of Offer Activities, announcement of prizes, cancellation/postponement of Promo, for any injury or damage to participant's or other person's computer or other device relating to or resulting from Promo participation, or for printing, typographical, human or other errors appearing in these Terms or other Promo-related materials. Information collected for Promo is used only for Promo administration, Activity verification, & winner notification, & will not be re-used, sold or shared by Released Parties or 3rd parties unless entrant has elected to receive additional information from Sponsor. Sponsor reserves right, in its sole discretion, to void any & all entries/submissions of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or Promo proper play. Promo Data generated by script, macro or other automated means or with intent to subvert the entry process are void.
Offer: (20,000) Vouchers /(5,000) Vouchers per Promo Date: (1) Voucher valid for (1) lunch at designated truck (Average Retail Value of Lunch=$10). Voucher will be valid only at participating truck where Voucher was received & must be redeemed on the Promo Date it was received during event operating hours. Lunch selection(s) provided solely at discretion of participating trucks & is subject to availability. Maximum Total Average Retail Value of all Vouchers=$200,000. Voucher quantities are limited. The first (500) qualifying Offer entrants per each of the (10) participating trucks per Promo Date who complete an Activity & obtain Activity verification by Sponsor's designated reps as described above receive (1) Voucher. Maximum of (500) Vouchers awarded per each of (10) participating trucks per Promo Date for a maximum total of (5,000) Vouchers awarded per Promo Date. By accepting Voucher, recipients agree to be bound by these Terms. (5) Sweepstakes Prizes: (1) Grand: (4) Lexus Club level tickets & pre-game on field passes to a 12/18/11 New York-area professional football game for winner & (3) guests (Approximate Retail Value "ARV"=$1,700). Exact nature & duration of on field access shall be determined by Sponsor in its discretion. Game may not be recorded, photographed/videotaped by attendees for any commercial purpose. (1) First: Private dinner party at restaurant to be designated by Sponsor on 12/18/11 for winner & (7) guests, including an appearance by a former professional football legend & cheerleaders to be determined by Sponsor (ARV=$1,000). (3) Second: Dinner at Red Rooster for winner & (1) guest in January 2012, including appearance by Red Rooster owner Marcus Samuelsson (ARV=$500). Winners & guests responsible for transportation to/from prize events & any applicable lodging. Exact nature of professional football legend, cheerleader & Marcus Samuelsson's participation in Promo at Sponsor's discretion. Game & dinner party attendees may not wear or display the corporate/commercial identification of any 3rd party without prior consent of Sponsor & may be required to wear apparel as directed by Sponsor. Winners & their guests agree to comply with all applicable venue rules & regulations relating to the use of game &/or event tickets &, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at the game &/or event. Winners & their guests will be escorted out of game for improper conduct &/or violation of federal, state or local laws (including, but not limited to, unlawful possession, use, or distribution of illicit drugs, unlawful drug paraphernalia, & alcohol) & will forfeit the balance of prize. Minor guest(s) (if any) must be accompanied by a parent/legal guardian. Exact seat locations to be determined solely by Sponsor. Total ARV of all Prizes=$4,200. Prize & Voucher details not specifically set forth herein are at Sponsor's discretion. All prizes & Vouchers are provided by Sponsor. Federal, state, & local taxes & all other expenses not specified herein are winners' sole responsibility. Sweepstakes Winner Selection: Winners will be selected in a random drawing on/about 11/28/11 from among all eligible Sweepstakes entries received. Odds of winning will depend on the number of eligible entries received. Drawing will be conducted by P/S/T, an independent judging organization whose decisions will be final/binding in all matters relating to Sweepstakes. Winners will be notified by P/S/T by email. Limit (1) prize per person, immediate family member, or household. Miscellaneous: No transfer, assignment, cash redemption or substitution of prize (or portion thereof) except by Sponsor due to unavailability or causes otherwise determined solely by Sponsor, & then for a prize (or applicable portion thereof) of equal/greater value. Sweepstakes winners required to execute & return an Affidavit of Eligibility, Liability Release & (where legal) Publicity Release within (3) days of notification issuance. Guests (if a minor, respective parent/legal guardian) required to sign & return a Liability Release & (where legal) Publicity Release prior to document issuance. Non-compliance with any of the foregoing may result in disqualification & awarding of prize to an alternate winner. If any prize notification email or prize is returned as undeliverable, winner will be disqualified & an alternate winner selected. By participating, entrants agree to be bound by these Terms & agree that: 1) Released Parties & their designees & assigns shall have the right & permission to use (unless prohibited by law) their name, voice, city/state of residence, biographical information, photograph, &/or likeness for advertising &/or trade &/or any other purpose in any media or format, online or offline, now or hereafter known without further compensation, permission, or notification & 2) Released Parties & their designees & assigns & all of their respective officers, directors, employees, shareholders, representatives & agents shall have no liability & will be held harmless for any liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by acceptance, possession, use or misuse of prize (including any activity related thereto), Voucher, or Promo participation. Sponsor can void submissions/entries & modify, terminate, or suspend Promo (or any portion thereof) should virus, bugs, non-authorized human intervention, actions of entrants, or other causes corrupt or impair Promo (or any portion thereof) administration, security, fairness or proper administration &, if Sweepstakes is modified, terminated or suspended, Sponsor may select Sweepstakes winners from among all eligible, non-suspect entries received during the applicable Promo Date(s) prior to event requiring such modification, termination, or suspension. CAUTION: Attempts to deliberately undermine the legitimate operation of Promo is a violation of criminal & civil laws & if such an attempt is made, Sponsor reserves right to seek damages (including attorneys' fees) &/or other remedies from person(s) responsible for attempt to fullest extent permitted by law.
